Second, if I ignored them outright, I could spend months and a lot of money fighting it.

He told me to document everything, involve the county if slope safety was at issue, and do nothing casually.

That county call changed everything.

I spoke with a building official and explained that I had been ordered by my HOA to remove a retaining wall on a steep residential slope.

The official immediately asked whether any new construction had taken place uphill or downhill that might have affected drainage.

I mentioned the pool project.

He got quiet for a second and asked whether I had noticed any new seepage.

I had.

Since the pool work finished, one corner behind my wall had stayed damp longer than usual even during a dry spell.

Not soaked, just wrong.

The kind of wrong you notice after a lifetime around wet ground.

The official said if I was going to remove anything, even partially, I needed erosion controls in place and he strongly recommended an inspector be present.

So that is what I arranged.

I scheduled the work for a dry week in late spring.

I set up silt fence, plastic, straw wattles, and had my mini excavator ready.

I also called the downhill neighbors and told them exactly what was happening.

Nobody was thrilled.

All of them knew the wall had protected the slope for years, and all of them were suddenly very interested in the fact that the HOA had put its order in writing.

The inspector arrived just after nine in the morning.

He was a practical guy in work boots and sunglasses, not the type to be impressed by anyone’s landscaping budget.

Vanessa came outside within ten minutes of seeing the county truck.

She stood on her pool terrace with her arms folded and asked why the county was there.

I told her because I like witnesses.

She did not appreciate that.

I started at one end of the wall where access was easiest.

The first railroad tie came out with the usual groan of old timber separating from compacted soil.

That part did not surprise me.

What did surprise me was the condition of the backfill.

It was wetter than it should have been.

Not winter-wet.

Actively wet.

I scraped a little farther.

Then I saw bright blue PVC.

It was not mine.

I had installed black perforated drain pipe wrapped in fabric two decades earlier.

This was newer, smooth-wall, pressure-rated line, and it was running from uphill toward the space directly behind my retaining wall.

The inspector stepped closer.

I cleared another foot of soil.

A trickle of water began to pulse from the cut area.

Then it thickened.

By the time I eased out the second timber, muddy water pushed through the opening in a heavy brown gush, carrying fine soil with it.

One of the fences downhill gave a low stressed creak.

The ground near the cut settled just enough for all of us to see it.

Vanessa came off that pool deck like someone had lit a fuse under her.

She started shouting that I could not leave the wall open, that I needed to stop immediately, that I was causing damage.

I held up the signed violation letter
